Gender Dysphoria and Section 504

Get the background and current status of the Texas v. Kennedy lawsuit (previously known as Texas v. Becerra), which was filed in Lubbock, Texas, in September 2024. The State of Texas, along with 16 other states, sued the United States Department of Health Services over the expansion of the definition of disability to include gender dysphoria, which may be considered a physical or mental impairment under Section 504 of the Rehabilitation Act. However, the lawsuit also seeks relief from the enforcement of Section 504, which would affect the disability rights of individuals who benefit from programs that receive federal funding.
